The Telehealth extension was not included in the American Relief Act of 2025 that President Biden recently signed into law. This means the temporarily extended Telehealth safe harbor from the CARES Act expired on December 31, 2024. Plans offering HDHPs with HSAs must ensure telehealth services do not meet any exceptions, which may disqualify individuals from contributing to an HSA for that plan year.
On December 23, 2024, President Biden signed into law the Paperwork Burden Reduction Act and the Employer Reporting Improvement Act.

With only two weeks remaining in 2024, Congress extends the Health Savings Account (HSA) telehealth relief for another two years until December 31, 2026.
Also, Affordable Care Act (ACA) reporting has become easier by removing the need to distribute the Forms 1095-C to full-time employees except upon request. ACA employer mandate penalty assessments are now subject to an extended 90-day review period and a six-year statute of limitations.
We will be releasing additional information in the coming weeks regarding how and when the new ACA reporting relief will be implemented.
